1. Introduction

Please read these Terms & Conditions ("T&Cs") carefully before purchasing a ticket or attending the Exmouth Wellness Festival ("the Festival"). By purchasing a ticket, entering the Festival site, or participating in any activity offered by eXhale ("we", "us", "our"), you ("you", "your", "ticket holder", "attendee") agree to abide by these Terms & Conditions in full.

These T&Cs apply to all Festival activities, including classes, workshops, talks, demonstrations, beach sessions, vendor interactions and all other services offered at the Festival.

 

2. Eligibility & Admission

• The Festival is strictly for attendees aged 18 and over. ID may be required.

• By attending, you confirm that you are 18+ and accept full responsibility for your participation.

• eXhale reserves the right to refuse entry or remove any attendee who violates these T&Cs or behaves disruptively or unsafely. No refunds will be issued in such circumstances.

 

3. Health, Fitness & Safety

3.1 Personal Responsibility

• You acknowledge that participating in a wellness festival on a beach involves inherent risks, including physical exertion, uneven ground, weather exposure, and environmental hazards.

• You participate entirely at your own risk.

• You are responsible for ensuring you are healthy, fit and capable of engaging safely in all activities you choose to attend.

• You must manage your hydration, sun protection and general wellbeing throughout the Festival.

 

3.2 Medical Conditions

• If you have any health concerns, injuries, or conditions, you must consult a qualified medical professional before participating.

• You must inform instructors of any relevant medical conditions before taking part in a session.

• eXhale reserves the right to deny participation if your health or safety may be at risk.

 

3.3 Beach & Environmental Risks

By attending a beach-based event, you accept risks including but not limited to:

• Uneven or shifting sand, shells, rocks and natural debris

• Exposure to sun, heat, wind, or sudden weather changes

• Tidal movement and proximity to water

• Reduced visibility at sunrise/sunset sessions

You agree to follow all safety instructions provided by instructors, lifeguards, stewards and staff.

 

4. Pregnancy

• None of the Festival's classes, workshops or activities are specifically designed for pregnancy.

• If you are pregnant, you may attend entirely at your own risk and only after consulting with a qualified medical professional.

• You accept full responsibility for your own wellbeing during all activities.

• You release eXhale and all instructors from any liability associated with participation while pregnant.

 

5. Required Equipment

• Attendees are responsible for bringing all necessary personal equipment for their chosen sessions, including:

• Yoga mat — required for yoga, pilates, mobility and workshop sessions

• Towels, water bottles, appropriate clothing and sun protection

• eXhale does not supply yoga mats or personal equipment unless explicitly stated.

• Failure to bring required equipment does not qualify for a refund or compensation.

 

6. Ticketing, Refunds & Cancellations

 

6.1 Ticket Purchases

• Tickets must be purchased in advance via www.exmouthwellnessfestival.co.uk.

• Tickets are valid only for the date(s) purchased.

 

6.2 Non-Refundable Policy

• All tickets are strictly non-refundable once purchased.

6.3 Force Majeure / Full Cancellation

If the Festival must be cancelled due to force majeure or unforeseen circumstances beyond our control — including severe weather, unsafe tidal conditions, natural disaster, venue failure, government restrictions, safety threats or health emergencies — all ticket holders will receive a full refund.

6.4 Schedule Changes

• eXhale reserves the right to alter, adjust or substitute any part of the Festival schedule at any time, including instructors, session times, locations or content.

• Schedule changes do not constitute grounds for refunds.

6.5 Partial Cancellation

If individual sessions are cancelled (e.g., due to weather, illness or safety concerns) but the Festival continues, no refunds will be given.

7. Liability & Waiver

By attending the Festival, you agree that:

• You voluntarily assume all risks associated with attendance and participation.

eXhale, its instructors, staff, volunteers and partners are not liable for:

• Any injury, illness or medical condition

• Loss or damage to personal belongings

• Accidents, slips, trips or falls

• Weather-related issues

• Third-party vendor actions

• Any indirect, incidental or consequential loss

You expressly waive all claims against eXhale to the fullest extent permitted by law.

 

8. Conduct & Behaviour

Attendees must:

• Behave respectfully towards staff, instructors, vendors and other participants

• Not attend under the influence of alcohol or illegal substances

• Follow all safety instructions

• Avoid disruptive or unsafe behaviour

Failure to comply may result in removal without refund.

 

9. Personal Belongings

• eXhale is not responsible for the loss, theft or damage of any personal items.

• Keep belongings with you at all times.

 

10. Weather Policy

• The Festival will proceed in varied weather including wind, heat and light rain.

• Extreme weather may result in temporary pauses, relocations or adjustments for safety.

• Such changes do not qualify for refunds.

 

11. Photography & Media

• By attending, you consent to photography and filming for promotional purposes.

• If you would prefer not to appear in media, please inform staff on arrival, though total avoidance cannot be guaranteed at a public event.

 

12. Vendors, Food & Drink

• Independent vendors operate onsite and are responsible for their own products and allergen information.

• eXhale is not liable for third-party vendor practices or food-related issues.

• Attendees are responsible for checking ingredients and consuming food and drink safely.

 

13. Data Protection & GDPR

• eXhale processes personal information lawfully and transparently.

• Data is used for communication, safety notifications and marketing purposes only.

• Data will not be shared with third parties.

• To update or remove your details, contact: exhale.fitness@outlook.com.

• Any significant data breach will be reported to the ICO within 72 hours.

 

14. Acceptance of Terms

By purchasing a ticket and attending the Festival, you confirm that you:

• Have read and understood these Terms & Conditions

• Accept all associated risks

• Agree to comply with all safety instructions and policies

• Waive any claims against eXhale to the fullest extent permitted by law
